The Court dismissed, at a preliminary stage, an action in defamation brought by Peter Sergakis, a well-known bar and restaurant owner, against Montreal city councillor Peter McQueen, deeming Sergakis’ action to be abusive and a SLAPP.
The judgment reaffirms the crucial importance of municipal councillors’ freedom of expression and the Court’s duty to act urgently when faced with a SLAPP. It is also one of the few judgments rendered in Quebec in which an action in defamation is dismissed at a preliminary stage based on the fact that it is a SLAPP.
