The BCCA upheld a successful libel defence.

Decision Summary

The Western Canada Wilderness Committee criticized an open pit mine proposal. The mining company sued and lost. The BCCA has upheld the rulings that:

(1) some of the postings were not defamatory as they were critical of the mining proposal, not defamatory of the company.

And

(2) that the statements that rose to the level of defamation, including statements that the action was a SLAPP, were fair comment. The court of appeal did overturn a special costs order and gave the Wilderness Committee regular costs.
